Resolution No. 46-P of the Constitutional Court of the Russian Federation

On 3 October 2023, the Constitutional Court of the Russian Federation passed resolution No. 46-P regarding the constitutionality of article 131(1) of the Russian Civil Code and article 14(2)(5) of the Federal Law “On the Public Registration of Real Property” in connection with a complaint brought by Ms T. V. Solodovnikova. The importance of this judicial resolution is such that it is only the second time that the Russian Constitutional Court has decided to address the issues of private arbitration. Roskomnadzor releases recommendations in connection with increasing personal data leaks

On its website, RoskomnadzorFederal Service for Supervision of Communications, Information Technology and Mass Media (Roskomnadzor) has published recommendations for personal data operators based on the findings of an analysis of databases that were leaked into the public domain. Russian Supreme Court refuses to recognise email addresses as personal data

In its Ruling No. 305-ЭС23-12160 dated 21 July 2023, the Supreme Court of the Russian Federation upheld the position of lower courts that an email address is not personal data. This decision may have far-reaching consequences for businesses, but we recommend taking a more conservative approach.
